Terms & Conditions

These terms and conditions apply to the lease of all the Equipment by the Lessor to the Lessee and shall not be overridden by any terms and conditions of the Lessee.

1. Definitions:

• a. “Equipment” means all the items and products specified in the Lease Agreement.
• b. “Lease Agreement” means these Terms and Condition along with Clauses referred in Agreement and Exhibits enclosed therein.
• c. “Misuse” means using Equipment in an incorrect, unsuitable or unintended manner, either accidentally or intentionally, usage in Extreme weather conditions.
• d. “Lessee” is the company, firm, person, corporation or public authority taking the Lessor’s Equipment on Lease and includes their Successors and personal representatives.
• e. “Lessor” means Capture cams rep. by its Authorized Signatory Dama Rohith Raj Varma or its successors or permitted assigns.
• f. “Cliente habitue/Habitual Client”means a regular, loyal customer who frequently receives products & services of the Lessor
• g. In these terms and conditions, except where the context otherwise requires, words denoting the singular include the plural and vice versa; words denoting any gender include all genders; words denoting persons include firms and corporations and vice versa. Headings in these Terms and Conditions are for ease of reference only and do not affect the construction of these Terms and Conditions.

2. Extent of Agreement:

• 2.1. No conditions or warranties other than herein specifically set forth shall be implied or deemed to be incorporated in or form part of the Lease Agreement. These Terms and Conditions along with Clauses in Agreement are the only terms upon which the Lessor will accept orders for Lease of Equipment. Any terms or conditions attached to the Lessee’s order or otherwise brought to the Lessor’s attention shall be of no effect unless repeated herein or specifically agreed in writing by the Lessor.
• 2.2. The Lessor reserves the right to amend and modify these Terms and Conditions at any time, such amendments and/or modifications being effective upon the discretion of the Lessor.
• 2.3. Any Quotation submitted by the Lessor to the Lessee shall not constitute an offer (but merely an invitation to treat which may be withdrawn by the Lessor at any time) and a binding contract for Lease shall only come into effect on the earlier of the entry into the Lease Contract or the commencement of the Lease period.
• 2.4. In entering into the Lease Agreement the Lessee has not relied upon any representations, statements, warranties or performance criteria whether verbal or written made by or on behalf of the Lessor, and the Lease Agreement constitutes the entire agreement and understanding between the Lessor and the Lessee.

3. Booking & Reservation:

Advance payment for Booking is Mandatory, without which Booking cannot be confirmed.

4. Lease Time Calculation:

Lease Periods may vary based on the range of products and availability during festive seasons. It cannot be assumed that a 24-hour period applies to the Lease Term. Kindly check the time slots for each product before booking.

5. Conditions of Lease:

Equipment shall be Leased at the rate specified by the Lessor.

6. Availability of Equipment:

The Lessor’s obligation to supply Equipment hereunder is subject to availability.

7. Documentation and ID Verification:

• 7.1. The Documentation process is mandatory where the lessee is required to provide Three (3) Original ID proofs in the name of the Lessee.
• 7.2. Lessor has every right to hold the Identity cards of the Lessee and upon return of equipment in good condition, Personal Id’s of the Lessee will be handed over to them without any fail subject to clearance of balance dues.
• 7.3. The rental order will not be handed over to other individuals in case of Registered persons. In case of Habitual Client as per clause 1(f) upon Formal request made by Lessee, the Lessor can handover Leased Equipment to their family member/team member subject to verification of ID cards provided by the Lessee in their formal request. The rental order, upon written/formal request made by Registered Company, shall be handed over to their authorized agent/authorized signatory/any assigned person subject to verification of necessary ID Cards provided by the Registered company in their formal request.
• 7.4. Valid ID must be provided at the time of Documentation otherwise the Booking will be cancelled by the Lessor without providing any refund.
• 7.5. Lessor reserves his right to verify the Id’s and Documents provided by the lessee at the time of booking confirmation and if the ID’s and Documents provided by the Lessee are found to be unauthenticated, the lessor have every right to proceed with appropriate legal action against the lessee.
• 7.6. For new unregistered Clients: Company conducts a Background verification and deliver the equipment with an assistant based on your orders.
• 7.7. For tourists and visitors, one local reference is Mandatory, where his/her ID cards and contact details will be collected for security purpose.
• 7.8. Verification & Validation of details provided by customer will be scrutinized by Intelligence and Legal teams.

8. Lessee’s responsibility:

During the continuance of the Lease period, the Lessee shall make good to the Lessor all loss or damage to the Equipment howsoever occurring and from whatever cause the same may arise, fair wear and tear excepted, and shall also fully and effectually indemnify on demand the Lessor in respect of all claims by any person whatsoever for injury to person or property caused by or in connection with or arising under statute or common law and in connection with the Lease Agreement. In the event of loss or damage to the Equipment, Lease charges shall continue until settlement has been effected. The Following are responsibilities of Lessee:

• 8.1. Proper Use: Using the Equipment in a careful and responsible manner, according to the Lessor’s instructions.
• 8.2. Safeguarding: Protecting the Equipment from loss, theft, damage or Misuse.
• 8.3. Return condition: Returning the Equipment in the same condition it was received, reasonable wear and tear excepted.
• 8.4. Reporting Issues: Immediately notifying Capture Cams of any damage, malfunction or loss of Equipment.
• 8.5. Liability: The Lessee herein is liable for any loss, damage, or repair costs to the equipment during the rental period, up to the full replacement values.
• 8.6. The Lessee herein cannot sub-lease the Cameras and Equipment leased out from the Lessor without prior Written consent from the Lessor.
• 8.7. The Lessee have no rights whatsoever to mortgage the equipment leased or illegal transfers to any other parties, in such a case severe penal action will be instituted against the Lessee.
• 8.8. The Lessee cannot misuse the Equipment leased for producing any illegal and Vulgar content, Equipment cannot be used in Government restricted places or Prohibited places, the Lessor cannot be held liable for the Misuse done, the Lessee shall be held responsible for all the Legal Proceeding against such violations.
• 8.9. The Lessee do not have any right to use the equipment for Testing (Hardware/software). In any such incident, the Lessee is Liable to pay full cost of the Equipment along with damages to the Lessor.
• 8.10. If the Lessee fails to return the product within 48hours of agreed End time and do not inform the company about failure to return the Equipment on time, Strict Legal Action i.e., Both Civil and Criminal Proceedings shall be taken against the Lessee.
